Aurizon Network’s approved 2010 access undertaking required it to submit a proposed standard rail connection agreement to the QCA for approval.
On 14 December 2012, we made a final decision to not approve the proposal, setting out how Aurizon Network should amend the proposal. Aurizon Network subsequently submitted an amended proposal, but this did not strictly comply with our final decision.
Thus, we developed, and subsequently approved, our own proposed SRCA.
The SRCA applied from 24 April 2013. Accordingly, unless otherwise agreed, any future rail connection agreements entered into during the term of the 2010 access undertaking had to be consistent with the terms of the SRCA.
Aurizon Network and a private infrastructure owner were allowed to agree to terms and conditions that differ from the SRCA, but in the event that negotiations fail, we would have regard to the SRCA in resolving a dispute.
On 27 June 2012, we made a draft decision to not approve Aurizon Network’s proposed SRCA.
On 30 June 2011, Aurizon Network submitted its proposed standard rail connection agreement (SRCA) to us for approval.
